Es un\u00a0<b>r\u00e9gimen laboral<\/b>\u00a0creado para los emprendedores, que por el tipo de negocio o contexto socio-empresarial, no generan los mismos ingresos que una\u00a0<b>empresa<\/b>\u00a0de\u00a0<b>r\u00e9gimen<\/b>\u00a0com\u00fan.<\/p>\n<ul>\n<li>El R\u00e9gimen de Promoci\u00f3n y Formalizaci\u00f3n de las MYPES se aplica a todos los trabajadores sujetos al r\u00e9gimen laboral de la actividad privada, que presten servicios en las Micro y Peque\u00f1as Empresas, as\u00ed como a sus conductores y empleadores.<\/li>\n<li>Los trabajadores contratados al amparo de la legislaci\u00f3n anterior continuar\u00e1n rigi\u00e9ndose por las normas vigentes al momento de su celebraci\u00f3n.<\/li>\n<li>No est\u00e1n incluidos en el \u00e1mbito de aplicaci\u00f3n laboral los trabajadores sujetos al r\u00e9gimen laboral com\u00fan, que cesen despu\u00e9s de la entrada en vigencia del Decreto Legislativo N\u00b0 1086 y sean inmediatamente contratados por el mismo empleador, salvo que haya transcurrido un (1) a\u00f1o desde el cese.<\/li>\n<li>Cr\u00e9ase el R\u00e9gimen Laboral Especial dirigido a fomentar la formalizaci\u00f3n y desarrollo de las Micro y Peque\u00f1a Empresa, y mejorar las condiciones de disfrute efectivo de los derechos de naturaleza laboral de los trabajadores de las mismas.<\/li>\n<\/ul>\n<p align=\"JUSTIFY\">Incluye los siguientes derechos:<\/p>\n<table style=\"height: 1014px;\" border=\"0\" width=\"623\" cellspacing=\"1\" cellpadding=\"2\" bgcolor=\"#6698FF\">\n<tbody>\n<tr>\n<td valign=\"top\" bgcolor=\"#CEE7FF\">&nbsp;<\/p>\n<p align=\"CENTER\"><b><span style=\"color: #000080;
